By accessing and using the services provided by neonstride B.V. ("we", "us", "our", "neonstride"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

These terms apply to all users of our real estate services, including property buyers, sellers, landlords, tenants, and website visitors.

neonstride provides professional real estate brokerage services in Amsterdam and surrounding areas, including:

• Property sales and purchase assistance
• Rental property services and management
• Property valuations and market analysis
• Investment advice and consultation
• Legal support for property transactions
• Property marketing and photography

All services are provided in accordance with Dutch real estate regulations and professional standards.

User Obligations

When using our services, you agree to:

• Provide accurate and complete information about your property requirements or property details
• Respond promptly to communications and requests for information
• Comply with all applicable laws and regulations related to property transactions
• Pay all agreed fees and charges in a timely manner
• Not use our services for any illegal or unauthorised purpose
• Respect the confidentiality of information shared during our professional relationship
• Notify us immediately of any changes to your contact information or requirements

Fees and Payment

Our fees for real estate services are agreed upon before commencement of work and may include:

• Commission fees for successful property sales or purchases
• Rental management fees for ongoing property management
• Consultation fees for advisory services
• Marketing and advertising costs (where applicable)

All fees are inclusive of applicable Dutch VAT. Payment terms will be specified in individual service agreements.

Intellectual Property

All content on our website and in our marketing materials, including text, graphics, logos, images, and software, is the property of neonstride or its content suppliers and is protected by Dutch and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission. Property photographs and descriptions created by neonstride remain our intellectual property until the conclusion of the service agreement.

The neonstride name and logo are trademarks of neonstride B.V. and may not be used without permission.

Confidentiality

We maintain strict confidentiality regarding all client information and property details. Information shared with us during our professional relationship will only be used for the purposes of providing our services and will not be disclosed to third parties without your consent, except where required by law.

You also agree to maintain confidentiality regarding any proprietary information or business practices disclosed during our service relationship.

Limitation of Liability

While we strive to provide accurate information and professional service, neonstride shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or any errors or omissions in the information provided.

Our total liability for any claims arising from our services shall not exceed the total fees paid by you for the specific service giving rise to the claim.

We are not responsible for:

• Market fluctuations affecting property values
• Changes in interest rates or lending criteria
• Legal or regulatory changes affecting property transactions
• Actions or omissions of third parties, including other professionals involved in transactions
• Technical issues with third-party websites or services

This limitation of liability does not affect any statutory rights you may have as a consumer under Dutch law.

neonstride operates under the regulations and professional standards governing real estate brokers in the Netherlands. We are committed to:

• Acting in the best interests of our clients
• Maintaining professional competence and integrity
• Complying with all applicable laws and regulations
• Providing clear and transparent communication
• Handling client funds and information securely

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the Dutch courts.

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Data Protection

Your personal data will be processed in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).

Termination

Either party may terminate a service agreement with reasonable notice, subject to any specific terms agreed upon in individual contracts. Upon termination:

• All outstanding fees become immediately due and payable
• Confidentiality obligations continue to apply
• Any work completed up to the termination date will be charged accordingly
• We will return any client materials in our possession

We reserve the right to terminate services immediately if there is a breach of these terms or if continuation of services would violate applicable laws or regulations.

We are committed to resolving any issues promptly and fairly. If a resolution cannot be reached, disputes may be referred to the appropriate professional body or resolved through Dutch legal procedures.
